Due to the unexpected death of Mayor Rawley McCoy, a special election was ordered to fill the vacancy in the office of mayor of the City of Victoria.  The unexpired term of office will end in May 2022.  

Cm. Jeff Bauknight filed for a place on the ballot of the mayoral special election.  An additional special election was ordered to fill his unexpired term as District 3 council member.  The unexpired term for District 3 will end in May 2024.

Below are legal references to the city code and Texas Constitution referencing the ordering of a special election.  

Section 4 of the City Charter states "In case of a vacancy in the office of the Mayor or any Council member, by refusal to accept or failure to qualify, or by death, resignation, or otherwise, the City Council shall order an election to fill such vacancy, and all special elections shall be conducted as provided for the holding of general elections for the City."

Article XI, Section 11 (c) of the Texas Constitution states "Any vacancy or vacancies occurring on such governing body shall not be filled by appointment but must be filled by majority vote of the qualified voters at a special election called for such purpose within one hundred and twenty (120) days after such vacancy or vacancies occur except that the municipality may provide by charter or charter amendment the procedure for filling a vacancy occurring on its governing body for an unexpired term of 12 months or less."
